TERMS OF USE

These Terms of Use ("Terms") govern your access to and use of games, mobile applications, websites, subscriptions, in-app purchases and other related services provided by Fenomen Software S.R.L. ("Fenomen Software", "we", "us", or "our").

By downloading, accessing or using any of our Services, you agree to these Terms. If you do not agree with these Terms, please do not use our Services.

1. OUR SERVICES

Fenomen Software develops and operates mobile games and related digital services. These Terms are intended to apply generally to our games, applications, websites and related services, including future products operated by Fenomen Software, unless a particular service has additional terms that expressly replace or supplement these Terms.

2. ELIGIBILITY

You may use our Services only if you are legally permitted to do so under the laws applicable to you. If you are a minor, you may use our Services only with the involvement and permission of a parent or legal guardian where required by applicable law.

3. ACCOUNTS AND ACCESS

Some Services may require an account or may provide account-related features. You are responsible for keeping your account information secure and for activity performed through your account. You agree to provide accurate information where information is requested.

4. IN-APP PURCHASES AND VIRTUAL ITEMS

Our games may offer optional purchases, including subscriptions, virtual currency, virtual items, premium features and other digital content. Purchases made through Google Play or the Apple App Store are processed by the applicable platform and are also subject to that platform's terms and policies.

Virtual currency and virtual items have no cash value, cannot normally be exchanged for real money, and are licensed to you for use within the applicable Service. Unless required by applicable law or the applicable store's policies, they are not transferable or redeemable for cash.

5. SUBSCRIPTIONS

5.1 Subscription Terms

Certain Services may offer auto-renewable subscriptions that provide recurring benefits such as premium features, virtual currency, ad-free access, tools, buildings, content or other benefits described in the applicable subscription offer.

Before completing a subscription purchase, the applicable offer will identify the subscription period, price, trial period if any, and the benefits included in the plan. Subscription benefits may vary between games and subscription plans.

5.2 Free Trials and Automatic Renewal

Where a free or discounted trial is offered, the trial period and conditions will be displayed before purchase. Unless cancelled before the trial ends, a subscription may automatically convert to a paid subscription according to the terms displayed at the time of purchase.

After the initial subscription period, the subscription will automatically renew for the applicable renewal period unless you cancel it before renewal, subject to the rules of the applicable app store.

5.3 Billing and Cancellation

Payment is charged through the app store account used to make the purchase. Fenomen Software does not directly receive or process your payment card information for purchases made through Google Play or the Apple App Store.

You can manage or cancel your subscription through the subscription management settings of the store through which you purchased it. Cancelling a subscription generally prevents the next renewal and does not necessarily end access immediately; access normally continues until the end of the already-paid subscription period, subject to the applicable store's rules and any applicable refund rights.

6. REFUNDS

Purchases made through Google Play or the Apple App Store are generally subject to the refund policies and procedures of the applicable store. Where required by applicable law, you retain any rights you may have regarding refunds, cancellation or withdrawal.

7. ACCEPTABLE USE

You agree not to:

• use our Services for unlawful or fraudulent purposes;
• attempt to interfere with, disrupt or damage our Services;
• use cheats, exploits, bots, unauthorized automation or modified clients;
• reverse engineer or attempt to obtain source code except where permitted by law;
• circumvent security, purchase restrictions or access controls;
• use our Services to infringe the rights of another person or entity; or
• otherwise misuse the Services in a way that may harm Fenomen Software, our users or our systems.

8. INTELLECTUAL PROPERTY

Our games, applications, software, graphics, characters, artwork, music, sounds, text, trademarks, logos, names and other content are owned by or licensed to Fenomen Software and are protected by applicable intellectual property laws.

Except for the limited right to use the Services for their intended purpose, these Terms do not transfer ownership of any intellectual property to you.

9. USER CONTENT

If a Service allows you to submit, upload or publish content, you remain responsible for that content. You must have the necessary rights to submit it and must not submit content that is unlawful, harmful, abusive, infringing or otherwise prohibited by the applicable Service.

10. THIRD-PARTY SERVICES

Our Services may use or integrate third-party services, including Google Play, Apple services, advertising providers, analytics providers, authentication services and other technology providers. Your use of those third-party services may also be subject to their own terms and policies.

11. ADVERTISING

Some of our Services may display advertising. Advertising availability and behavior may differ between free and premium versions of our Services. Subscription benefits may include removal of advertisements where expressly stated in the applicable offer.

12. PRIVACY

Your use of our Services is also governed by our Privacy Policy, which explains how we collect, use, store and share information.

13. SERVICE CHANGES AND AVAILABILITY

We may update, modify, suspend or discontinue features of our Services from time to time, including for maintenance, security, technical, legal or business reasons. We will make reasonable efforts to maintain the Services, but we do not guarantee that every Service or feature will always be available or error-free.

14. SUSPENSION OR TERMINATION

We may suspend or terminate access to a Service or account where we reasonably believe that you have violated these Terms, applicable law, or rules designed to protect the Service and its users. Where required by applicable law, you may have additional rights regarding termination or suspension.

15. DISCLAIMER

To the maximum extent permitted by applicable law, the Services are provided on an "as is" and "as available" basis. We do not guarantee that the Services will always be uninterrupted, secure, accurate or free from errors.

16. LIMITATION OF LIABILITY

To the maximum extent permitted by applicable law, Fenomen Software will not be liable for indirect, incidental, special, consequential or punitive damages arising from or related to your use of the Services. Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited under applicable law.

17. CHANGES TO THESE TERMS

We may update these Terms from time to time. When we make changes, we will update the "Last updated" date on this page. Continued use of the Services after an updated version becomes effective constitutes acceptance of the revised Terms to the extent permitted by applicable law.

18. GOVERNING LAW

These Terms are governed by the laws applicable to Fenomen Software S.R.L., without prejudice to any mandatory consumer protection rights that may apply in your country or region.
